MY DAD, MY HERO CONTEST

Who Can Enter

1.                  Nominators and nominees must be legal Minnesota residents who are 18 years of age or older and have lawful access to the method of entry set forth in these rules. 

2.                  Employees of FOX/UTV Holdings, Inc, owner of television stations KMSP and WFTC, Famous Dave’s, and Fireside Hearth & Home (collectively, “Sponsor”), their affiliated companies, advertising and promotion agencies, and the immediate family and household members of each are ineligible.

How To Enter

3.                  No purchase is necessary to enter or win.  Limit of one entry per email address.  The contest begins when announced on May 27, 2013, and all entries must be received by 5:00 p.m. local time on June 7, 2013.    

4.                  There are two ways to enter: i) Entrants may enter by accessing the online My Dad, My Hero entry form at www.facebook.com/fox9kmsp, upload a photo of the nominator’s father, and describe in 150-200 words why the nominator’s father is their hero and why he should win the “My Dad, My Hero” contest; or ii) Entrants may enter online at www.myfox9.com by accessing the online My Dad, My Hero entry form, upload a photo of the nominator’s father, and describe in 150-200 words why the nominator’s father is their hero and why he should win the “My Dad, My Hero” contest.  The name of the nominator, the name of the nominator’s father, the nominator’s phone number, and the nominator’s e-mail address must be submitted for entry.  Photographs may be no bigger than 5 megabytes.

5.                  All submissions must be original and nominators must own the copyright to, or otherwise have all necessary rights in, their entry materials.  NO PROFESSIONAL PHOTOGRAPHS MAY BE SUBMITTED UNLESS ACCOMPANIED BY A SIGNED RELEASE FROM THE PHOTOGRAPHER. All photographs must conform to Sponsor’s then-current standards and practices and policies as established or determined by Sponsor in its sole discretion.  Without limiting the foregoing, submissions may not contain profanity or references to violence, or demean any gender, race, religion or sexual orientation.  Sponsor reserves the right to disqualify any entrant or remove any entry based on any claim of a third party, including, without limitation, copyright infringement or misappropriation of likeness.  Entry constitutes an unlimited perpetual license to Sponsor to use entry materials, including, but not limited to, the right to copy, distribute, publicly perform and display the entry materials on its websites, television stations and in any and all media whether now known or hereinafter invented.

6.                  Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry, winners or other contest information by Sponsor or entrants for any reason whatsoever.  Sponsor is also not responsible for any injury or damage to any entrant’s or any other person’s computer related to or resulting from playing or downloading any materials in the contest or for entries that are late, misdirected or incomplete.  All entry materials may be maintained as part of KMSP’s contest records.  CAUTION:  ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE CONTEST IS A VIOLATION OF THE CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.  Sponsor reserves the right to cancel or modify the contest if it becomes technically or otherwise corrupted.

7.                  Nine winners will be chosen on or about June 10, 2013.  Winners will be selected based on the photograph and accompanying essay describing why the nominator’s father (or father figure) is his or her hero and why he should win the “My Dad, My Hero” Contest.  Winners will be announced (Monday through Friday) during the week of June 10, 2013, and will have their photos shown and names announced during the “FOX 9 Morning News” between 6:00 a.m. and 9:00 a.m. and/or the “FOX 9 News at 5” between 5:00 p.m. and 6:00 p.m. 

The Prize

8.                  Each winner will receive a prize package that includes a $100 gift certificate to Famous Dave’s and a Broil King Porta Chef Pro portable grill from Fireside Hearth & Home.  The approximate retail value of each prize is $289.  The prizes are provided by Famous Dave’s and Fireside Hearth & Home.

9.                  The winners will be notified by phone on or about June 10, 2013.  Each winner will be required to complete, sign and return a Certification of Eligibility and Release and claim the prize in a manner determined by Sponsor in its sole discretion within 4 days of the date of notification or they will be disqualified.   If a winner cannot be reached, or if a winner does not return the signed and completed Certification of Eligibility and Release and claim the prize within the designated time period, Sponsor will select an alternate winner by the aforementioned criterion if, in Sponsor’s reasonable discretion, time permits. 

10.              Prizes cannot be redeemed for cash or substituted for any other items by the winners.  The winners cannot assign or transfer prize.  Sponsor reserves the right to substitute a prize of like or greater value, including cash, for any prize, for any reason.

11.              The winners are responsible for all local, county, state, and federal taxes on prizes based on the value of the prizes set forth in these rules.

12.              Only one prize will be awarded per household.  Individuals are eligible to win only one prize within any 60-day period, regardless of the number of contests entered.

Odds of Winning Miscellaneous

13.              Odds of winning depend on the number of entries received and the subjective judgment of the judges.

14.              Except where prohibited by law, entry constitutes permission to use winners’ names, hometowns, likenesses, and photographs for broadcast, online posting, and/or any in any other media, including for advertising and publicity purposes, without additional compensation.

15.              These contest rules are available at www.myfox9.com, and Monday through Friday during normal business hours at KMSP-TV, 11358 Viking Drive, Eden Prairie, MN  55344, through June 7, 2013.

16.              For a list of prize winners, send a separate, self-addressed, stamped envelope after June 10, 2013 to: KMSP-TV, Attn: My Dad, My Hero, 11358 Viking Drive, Eden Prairie, MN  55344.

17.              This contest is subject to all applicable laws and regulations and is void where prohibited or restricted by law, including without limitation, in jurisdictions requiring registration, filing, trust account, or posting of a bond, or any other requirements or disclosures that are not expressly satisfied by these rules.  Sponsor is not responsible for typographical or other errors in the printing, offering, or administration of the contest, or in the announcement of the prize.  In the event of a dispute over who submitted a particular entry, Sponsor will determine the entrant’s identity or select an alternate winner, in its sole discretion.

18.              By entering, participants represent that they are eligible, and agree (a) to be bound by these rules and the decisions of the judges, (b) to release Sponsor, its parent, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of any prize, and (c) to Sponsor’s use of entrants’ personal information as described in the Privacy Policy located at www.myfox9.com.

19.              This contest is not sponsored, endorsed, or administered by or associated with Facebook.  Entry information is provided to Sponsor, not to Facebook.  Entrants release Facebook from any and all liability for any injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of any prize.
